For cancellable reservations (no charge if you cancel more than 30 days before the arrival date, between 30 and 15 days before the arrival date: 50% charge, less than 15 days: 100% of the reservation):

- 50% of the total cost of the stay is charged at the time of booking via the secure online payment system STRIPE

- The balance must be paid no later than 15 days before your arrival. Payment can be made to the card provided at the time of booking or by bank transfer; in the latter case, please let me know as soon as possible.

For non-cancellable and non-refundable bookings, the full amount of the stay will be charged at the time of booking.

Terms and conditions of sale for Domaine Du Mimosa:

1. Object

These terms and conditions define the rights and obligations of the parties in the context of remote booking of services offered by our establishment, whose contact details are specified in this booking confirmation document. They govern all the steps necessary for booking and managing the booking between the contracting parties. The client acknowledges having read and accepted these terms and conditions of sale and the terms and conditions of sale for the reserved rate, accessible on our booking platform. These terms and conditions of sale apply to all bookings made online via our booking platform.

2. Reservation

The customer chooses the services presented on our booking platform. The customer acknowledges having reviewed the nature, purpose, and booking procedures for the services available on our booking platform and having requested and obtained all necessary and/or additional information to make an informed booking. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process.

3. Booking Process

Reservations made by the customer are processed via the online booking form accessible on our booking platform. The reservation is considered confirmed upon receipt of the booking form. Prior to making any reservation, the customer agrees to complete all required information on the booking form or request. The customer attests to the truthfulness and accuracy of the information provided. After the final selection of services to be booked, the booking procedure includes, in particular, entering the credit card details in the event of a guarantee or prepayment request, consulting and accepting the general terms and conditions of sale and the terms and conditions of sale of the reserved rate before validating the booking and, finally, the validation of the booking by the customer.

4. Booking confirmation

Our booking platform acknowledges receipt of the customer's reservation by sending an email without delay. In the case of online bookings, the email confirmation summarizes the contract offer, the services booked, the prices, the terms and conditions of sale related to the selected rate and accepted by the customer, the booking date, after-sales service information, and the address of the seller's establishment where the customer can submit complaints.

5. Cancellation or modification due to the customer

Customers are reminded, in accordance with Article L. 121-21-8 12° of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 121-21 of the French Consumer Code. The terms and conditions of the reserved rate specify the cancellation and/or modification procedures. Reservations with prepayment cannot be modified or cancelled. Advance payments, such as deposits, are non-refundable. This is stated in the terms and conditions of the reserved rate. When permitted by the terms and conditions of the reserved rate, the reservation can be cancelled directly with the establishment, whose telephone number is provided on the booking confirmation sent by email. All reservations are non-transferable and cannot be assigned to a third party, whether free of charge or for payment.

6. Consumption of the service

In accordance with regulations in force in certain countries, guests may be asked to complete a police registration form upon arrival. To this end, guests will be asked to present identification to verify whether or not they are required to complete the form. Any behavior contrary to public decency and order will result in the establishment asking the guest to leave the premises without any compensation or refund, even if payment has already been made. For establishments with internal regulations, the guest accepts and agrees to abide by said regulations. In the event of a guest's failure to comply with any provision of the internal regulations, the establishment will be obliged to ask the guest to leave the premises without any compensation or refund, even if payment has already been made.

7. Responsibility

The photographs displayed on our booking platform are not contractual. While every effort is made to ensure that the photographs, graphic representations, and texts used to illustrate the establishments presented provide as accurate a view as possible of the services offered, variations may occur between the time of booking and the day the service is used. The establishment cannot be held liable for the non-execution or improper execution of the booking in cases of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or in the event of unauthorized prepayment by the cardholder's bank. Any booking or payment that is irregular, invalid, incomplete, or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client's expense, without prejudice to any civil or criminal action against the client.

8. Condition reports and inventory

A joint inspection of the premises will be carried out, and failing that, the Organizers acknowledge that the premises made available to them are in perfect working order and undertake to maintain them in the same condition for the entire duration of the event. Any damage or deterioration in the reserved areas will be billed to the Organizers, signatories of this contract, after a quote has been issued or upon presentation of invoices.

9. Complaints

Claims relating to the non-performance or poor performance of the services booked must, under penalty of forfeiture, be brought to our attention in writing within eight days after the date of departure from the establishment.

10. Price

The prices for booking services are indicated before and during the booking process. Prices are confirmed to the customer inclusive of all taxes, in the establishment's local currency, and are valid only for the period indicated on the booking platform. If payment is made to the establishment in a currency other than that confirmed on the booking, the exchange fees are the responsibility of the customer. All bookings, regardless of origin, are payable in the establishment's local currency, unless otherwise specified on-site. Unless otherwise stated on the booking platform, additional services are not included in the price. Any applicable taxes (local taxes, tourist taxes, etc.), shown on the rates page, are payable directly to the establishment on-site. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the date of invoicing.

11. Payment

The customer provides their bank details as a guarantee for the reservation, except in the case of special conditions or rates, by credit or debit card (Visa, Mastercard, American Express, Diners Club, etc., depending on the options offered by the establishment's booking platform). The card number, without spaces between the digits, as well as its expiry date (it is specified that the bank card used must be valid at the time of service) and the security code, must be entered directly in the designated area (secure entry via SSL encryption). The customer must present the bank card used to guarantee the reservation upon arrival at the establishment. Payment is processed at the establishment during the stay, except in the case of special conditions or rates where partial or full payment is processed at the time of booking. This prepayment is considered a deposit. In the event of a no-show (reservation not cancelled – guest not present) for a reservation guaranteed by credit card, the establishment will charge the guest, as a fixed penalty, the amount indicated in its general and specific terms and conditions of sale. The establishment has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the guest's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the guest should contact their bank and the establishment to confirm their reservation and payment method. In the case of a rate requiring online prepayment, the advance payment, which constitutes the deposit, is debited at the time of booking. Some establishments may generate invoices/receipts electronically; the original file is certified and available online at the web address provided by the establishment.

12. Respect for privacy

On each personal data collection form, the customer is informed whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, and its service providers (including online payment providers). The customer authorizes elloha.com to share their personal data with third parties, provided that such sharing is compatible with the performance of elloha's obligations.Constellation SAS and Stripe.com, in accordance with these terms and conditions and the Customer Charter for the Protection of Personal Data, will process your payment. Specifically, during online payment, your bank details will be transmitted by the payment provider, stripe.com, to the establishment's bank for the execution of the booking contract. You are informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by the French Data Protection Act (Loi Informatique et Libertés). However, you consent to this transfer, which is necessary for the execution of your booking. Constellation SAS and Stripe.com, acting in their professional capacity, have committed to the establishment to take all necessary security measures and ensure the confidentiality of data during these data transfers.

13. Convention on Evidence

Entering the required bank details, along with accepting these terms and conditions and the booking confirmation or request, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature. The computerized records stored in the elloha.com computer systems will be kept under reasonable security conditions and considered proof of communications, orders, and payments between the parties. The customer is informed that their IP address is recorded at the time of booking.

14. Dispute Resolution

These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may apply in the country of residence of the consumers.

15. Internal Regulations
The owner will do everything in her power to ensure that the service is provided under the conditions stipulated in the reservation.The number of participants present may not exceed the prescribed number for each location without the owner's agreement. Should this number be exceeded, after prior agreement with the owners, each additional person will be subject to an additional charge of €60 per day. Any equipment or object that could prove dangerous for the rental or for those present, including the estate staff, will be refused. Appropriate attire and respectful behavior are required. Any offender may be refused entry or expelled from the property without refund of the price paid. The owners reserve the right to take any action they deem necessary. The client must ensure compliance with Decree No. 2017-1244 of August 7, 2017, concerning provisions applicable to neighborhood noise. The client must ensure compliance with Decree No. 98-1143 of December 15, 1998, setting the conditions for noise emissions. No parties may be held on the property without the owner's prior consent. The renter must use only the premises made available for the event. No fireworks, firecrackers, or other pyrotechnic devices may be set off on the property except by providers selected by Domaine du Mimosa and with the owner's permission. All ball games such as football, rugby, or others are strictly prohibited. Any form of climbing on trees or structures on the property, both indoors and outdoors, such as rocks, walls, or other structures, is also prohibited. Camping and parking of motorhomes are strictly prohibited. In the event of a breach of this rule, the owners will immediately terminate the rental agreement. The owners reserve the right to claim damages for any harm they may suffer as a result of the client's failure to comply with any of the provisions herein and for any damage caused by the client.

16. SecurityThe owners decline all responsibility in the event of an accident, theft, vandalism, or fire that may occur on the Domaine du Mimosa and request that the organizers, signatories of this contract, inform their guests and all service providers accordingly. The Domaine du Mimosa has one swimming pool. Supervision is the responsibility of the signatory organizers. The owners cannot be held liable. In the event of a breach of these rules, the owners of the Domaine du Mimosa reserve the right to terminate the service and disclaim all responsibility for any accidents that may occur.

17. Insurance
The client must insure against occasional rental risks and declares that they are insured with a reputable and solvent company for their civil liability. The owners decline all responsibility in case of theft or damage caused to any type of object or property (personal effects, hand luggage, equipment belonging to the clients or entrusted to them).Similarly, the client will take good care of the equipment and premises used for the event to ensure they do not suffer any damage or breakage. In the event of damage caused by the client, immediate compensation may be demanded.

18. Personal Data
The personal data provided by the client will be processed electronically by the owner, particularly within the framework of the execution and management of its contractual relationship with the client and its legitimate interest in improving the quality and operational excellence of the services offered to these clients, or in compliance with certain regulatory obligations.

19. Special Covid:In the event that the client is prohibited from accessing the property due to a general decision by the French government or general travel or border crossing restrictions imposed by the government of the client's country of residence, the client will be offered a postponement within 6 months under the same conditions and at no additional cost, subject to property availability. If the postponement is beyond 6 months, the current seasonal rate will apply. The implementation of medical surveillance measures, quarantine, capacity limits, mask-wearing requirements, or any equivalent public or personal health measures is not considered an inability to travel. Should the postponement offers be refused by the organizers and the cancellation be initiated by the organizers, the deposits paid for the reservation will be retained by the owner.

20. Force majeureThe Owner reserves the right to postpone a rental at any time and without prejudice for serious reasons, including but not limited to partial or total damage to the premises, serious events that could affect the safety of persons, force majeure, or urgent work necessary for the safety of persons and property. The organizers, signatories to this contract, will not be entitled to any compensation in such cases. A postponement will be offered within 6 months, subject to the availability of the property, under the same conditions. If a postponement proves impossible within 6 months, the current seasonal rate will apply. In the event that the postponement proposals are refused by the organizers and the cancellation is initiated by the organizers, the deposits paid for the reservation will be retained by the owner.

21. Entirety

These General Terms and Conditions of Sale, the terms and conditions of the rate booked by the customer, and the booking confirmation or request constitute the entire agreement between the parties. No general or specific terms and conditions communicated by the customer may be incorporated into these General Terms and Conditions. The documents forming the contractual commitments between the parties are, in descending order of priority, the booking confirmation or request (including the specific terms and conditions of the booked rate) and these General Terms and Conditions. In the event of any conflict between the booking confirmation and the General Terms and Conditions, the provisions of the booking confirmation shall prevail with respect to the obligation in question. These General Terms and Conditions of Sale may be modified and/or supplemented by the establishment at any time. In such cases, the establishment will publish the new version of the General Terms and Conditions of Sale online. Once published online, the new version of the General Terms and Conditions of Sale will automatically apply to all customers.
